兵庫県の斎藤元彦知事が再選した11月の知事選を巡り、斎藤氏らに対する公選法違反罪での告発状が兵庫県警などに送付されたことが2日、明らかになった。告発状は斎藤氏側の交流サイト（SNS）戦略に関わったPR会社に支出された約70万円が「無償であるべき選挙運動への報酬だ」と主張するが、斎藤氏側は「ポスター制作などの対価だ」と違法性を否定する。捜査当局は今後、告発状を受理するかどうかを含め慎重に判断するとみられる。
■選挙運動か
PR会社の代表は11月20日、インターネットの投稿プラットフォームに、斎藤氏陣営の《広報全般を任せていただいた》《私が監修者として、選挙戦略立案、アカウントの立ち上げ、コンテンツ企画などを責任を持って行った》などと投稿した。SNSの運用戦略を段階的に「種まき」「育成」などとも記したが、その後削除した。
告発状は投稿の内容などから、PR会社側によるSNS運用が「ネットを利用した選挙運動に該当する」と指摘。斎藤氏の代理人弁護士も11月27日の記者会見で「（代表個人が）例えば選挙期間中に動画をアップするとなれば選挙運動と目される」と述べる一方、代表以外の社員は「（選挙運動に）携わっていない」と主張している。
■報酬の趣旨は
今回の疑惑が公選法違反に当たるか否かで、最大の焦点となるのが報酬の趣旨だ。
斎藤氏の代理人はPR会社から送られた請求書に基づき、ポスターや公約スライドの制作など5項目に計71万5千円を支払ったと説明。「（ポスター代などは）政治活動や立候補の準備行為として対価の支払いは法で認められている」とし、5項目以外の代表の活動は「個人による無償ボランティアだ」と強調する。
これに対し告発状は、斎藤氏の代理人が会見で請求書を示しながら見積書は公開しておらず、業務に見合う支払いかどうかは不明だとした。一方で、斎藤氏陣営の中心メンバーとPR会社代表とのSNSでのやりとりなどを挙げ、代表がSNS戦略を担っていたと指摘。支払いにはSNS業務も含まれているとして違法性を主張する。
