生活保護費の引き下げは憲法違反として、京都市の受給者らが国などを訴えた控訴審判決で、大阪高裁は原告の逆転勝訴を言い渡しました。
京都市に住む生活保護の受給者42人は、国などが2013年から15年にかけて物価の下落などを理由に支給額を引き下げたのは、「健康で文化的な最低限度の生活」を保障する憲法に違反するとして取り消しを求めています。
一審の京都地裁は訴えを退け、原告らは控訴していました。
13日の控訴審判決で、大阪高裁は「国の判断は最低限度の生活を具体化する過程に誤りがあり違法である」などと指摘。引き下げを取り消すよう命じました。
