企業などに属さずフリーランスとして働く人の環境を整備するための法律が、11月1日に施行されます。フリーランスの人への報酬を60日以内に支払うことなどが企業などに義務付けられます。
11月1日に施行されるのは「フリーランス・事業者間取引適正化等法」で、フリーランスとして働く人が不当な扱いを受けないよう、業務を委託する企業などに義務を課すものです。業種や業界の限定はなく、今年11月1日以降に締結、更新された契約が対象です。
まず、企業がフリーランスの人に委託した業務の内容、納品日、報酬の額、支払期日などの取引条件について、「口約束」などではなく、「書面」かメール、SNSのメッセージなど「電磁的方法」いずれかで明らかにすることが企業側に義務付けられます。（この「取引条件の明示義務」はフリーランス同士の取引でも義務となります）
また、報酬について、企業側は発注した物品等を受けとった日から原則60日以内のできる限り早い日を支払期日として設定し、それまでに報酬を支払わなければなりません。
■「これもついでにタダでよろしく」はダメ 7つの禁止事項
また1か月以上の業務委託をした場合、企業側には、次の7つの行為が禁止されます。
1.（委託した物の）受けとり拒否
2.報酬の減額
3.返品
4.買いたたき（通常の場合に比べて非常に低い報酬など）
5.正当な理由なく発注側が指定する物品の購入や利用の強制
6.経済上の利益提供を不当に要請する（契約にはない荷積み作業を「ついでによろしく」などと頼む）
7.不当に内容変更・やり直しを命じる
こうした行為は、フリーランスの人の了解や合意を得たり、発注側に違法性の意識がなかったりしても違法となります。
